These general terms and conditions govern the contractual relationship between Den Boom in BV, with registered office at B-3012 Wilsele, Boomgaardstraat 26, with company number BE1016437066, and the customer, who orders the services and goods of Den Boom In exclusively for non-professional purposes.
Any situation not covered by our general or special terms and conditions shall be governed by the generally applicable legal regulations. The Trade Practices Act of 14 July 1991 and the Civil Code shall be used as the basis for establishing relations with the consumer prior to the conclusion of the agreement.
Intellectual property rights
The content of this website, including brands, logos, drawings, data, product or company names, texts, images, etc., is protected by intellectual property rights and belongs to the owner of the website or entitled third parties.
Limitation of liability
The information on the website is of a general nature. The information is not adapted to personal or specific circumstances, and therefore cannot be considered as personal, professional or legal advice to the user.
The content of the website (including links) may be adapted, modified or supplemented at any time without prior notice or notification.

Order
Orders placed via the Den Boom In BV website are always subject to acceptance of the general terms and conditions. Den Boom In BV reserves the right not to process inaccurate or incomplete order forms.
Waiver clause Wine purchase
The consumer has the right to inform the seller that he is cancelling the purchase without penalty and without giving any reason, within 14 working days from the day following the delivery of the product or the conclusion of the service agreement. After cancellation, you have another 14 days to return your product. You will then be credited with the full order amount including shipping costs. The consumer must then return the goods at their own expense, after which Den Boom In BV will refund the purchase price within 14 days of your return, provided that the goods are returned in good condition.
Cancellation of stay
Once a definitive reservation for the Volkswasserij has been made and confirmed, the following applies to cancellation of that reservation:
- Cancellation more than 24 hours in advance is free of charge, excluding any fees charged by the booking websites.
- For cancellations less than 24 hours before the arrival date, the cancellation fee is 100%.
To be eligible for a refund of the amount paid, you must report the cancellation as soon as possible via the booking platform.
No refunds will be given in the event of early departure. Cancellation fees will also be charged if you do not show up (No Show).
Liability during stay
Den Boom In BV cannot be held liable for damage suffered by the guest or third parties as a result of staying in the room in question. The guest indemnifies Den Boom In against any claims in this regard.
Den Boom In is not liable for disruptions in and around the accommodation, such as power failures, WiFi outages, water supply disruptions, and technical installation failures, nor for construction and/or road works in the vicinity of Den Boom In BV that are not announced or announced late.
Den Boom In BV accepts no liability for loss, theft, damage or accidents caused to persons and/or goods during or as a result of staying at De Volkswasserij accommodation.
The guest named in the booking confirmation is responsible for ensuring that everything runs smoothly in and around the rented accommodation.
The items must be handled with care, and the accommodation must be left tidy and in good condition.
This also applies to the use of items in the communal laundry facilities, such as: the kitchen, sanitary facilities and indoor and outdoor areas.
Any breakage or damage must therefore be reported by the guest directly to the owner.
Any repair and/or replacement costs must be reimbursed by the guest to the owner immediately upon the owner's first request.
If, after check-out, it turns out that items have been left behind in a damaged state and this has not been reported to the owner, the bill for the repair and/or replacement costs will still be charged.
Safety during your stay
For your own safety and that of the public laundry, smoking and open flames are prohibited inside the accommodation.
The misuse of fire extinguishers or disabling the smoke detector is not permitted.
Alcohol & Responsibility
We do not sell alcohol to persons under the age of 18. By placing your order, you hereby declare that you are responsible for your purchase and are over the age of 18.
Contracting party
We only sell to:
1. Natural persons over the age of 18
2. Legal entities with registered offices in Belgium and the Netherlands. By accepting these general terms and conditions, the customer declares that he/she is over 18 years of age.
Delivery
Customer service is very important to us. We do our utmost to deliver everything as quickly as possible.
Prices
Prices and rates are always expressed in euros and apply per unit, as stated on the website at the time of ordering or while stocks last (while stocks last). All prices include excise duties, VAT (21%) and packaging levies in Belgium, but exclude accommodation taxes that must be paid on location.
Den Boom In BV reserves the right to change prices and correct any typographical errors. If this would disadvantage you, you will be notified by email. You then have the right to cancel your order. In addition, Den Boom In BV may change prices if these price changes are due to objective circumstances (VAT, taxes on goods, packaging materials, transport, accommodation taxes, etc.).
All offers made by Den Boom In BV are without obligation. Offers are subject to availability (while stocks last). In the unlikely event that a product/service is no longer available, you will be contacted and offered an alternative if possible. You then have the right to cancel your order.
The prices do not include the costs of cancellation and/or travel insurance and/or other costs.
Payment
Den Boom In BV offers you the most secure online payment options.
Invoices must be paid by the due date at the latest to a bank account number specified by Den Boom In BV or via the online payment system. In the event of partial delivery, the customer undertakes to pay for the goods already delivered, in accordance with the prices stated on the invoice. Complaints regarding the invoice must be reported to Den Boom In BV by email within 8 days of the invoice date.
If one or more invoices have not been paid or have been paid late, as well as in the event of bankruptcy, administration, collective debt settlement and any other indication of apparent insolvency or incapacity, Den Boom In BV reserves the right to refuse orders and may also suspend a current order as long as invoices have not been paid or have not been paid in full, without Den Boom In BV being or becoming liable for any compensation.
The amounts of our invoices are payable upon delivery of the ordered goods, net without discount. In the event of late payment, the amount will be increased by 15% with a minimum of 20 euros for damages and loss of interest, without the need for a notice of default. In the event of a dispute, only the courts of Leuven shall have jurisdiction to judge it.
Retention of title
All delivered products remain the exclusive property of Den Boom In BV until they have been paid for in full, even if they have been modified or incorporated, and without prejudice to the customer's obligation to insure the products against risks and to take care of them with due diligence. The customer shall refrain at all times from reselling the products under a name or brand other than that designated by Den Boom In BV.
Warranty
In the event of visible defects (broken glass, missing items, etc.), the customer must immediately make a delivery reservation, otherwise a complaint based on this will no longer be valid. The customer must also notify Den Boom In BV of this by email within 14 days of delivery.
Force majeure
Den Boom In BV is never liable for force majeure situations or any other cause beyond its control (war, strike, breakage, theft, fire, logistical problems with transporters and third parties appointed, etc.) which could result in Den Boom In BV being unable to fulfil its obligations or unable to do so on time, although it will always endeavour to do everything in its power to execute the agreement, even if delayed, without being liable for compensation.
Display on websites
De Volkswasserij (B&B) is described on various websites. These websites have been compiled with the utmost care, but there may be differences between the text and/or photos presented on the website and the actual situation at Bed & Breakfast De Tijd at the time of our guests' visit.
Guests may not derive any rights from such differences.
Room capacity
De Volkswasserij (B&B) has two rooms, each with a double bed. The sofa in the living room can also be used as an extra bed. However, the mattress and sleeping quality of this sofa bed is not of the same quality as the beds in the rooms.
Arrival and departure times
On the day of arrival, your room will be available from 3 p.m. The agreed arrival times are approximate times, but if you arrive much later or earlier, you run the risk that no one from Den Boom In BV will be there to welcome you. However, we can ensure that you can enter at any time.
Different times are possible by arrangement.
In connection with the cleaning of the rooms, you must vacate them by 11:00 a.m. on the day of departure, unless otherwise agreed.
Parking
The car may be parked in public spaces in car parks and along the roadside. Parking is entirely at your own risk.
Applicable law and jurisdiction
All our agreements, including the special and general contract and invoice terms and conditions, as well as their implementation, are subject to Belgian law. The invalidity of one or more parts of these terms and conditions shall in no case result in the invalidity of the entire agreement, but only in the invalidity of the part in question. The other provisions shall therefore remain fully and unaffectedly applicable. In the event of any dispute, Belgian law shall apply and the courts of the judicial district of Leuven shall have jurisdiction, at the discretion of Den Boom In BV.
